هل يجوز إعطاء الفقير من الزكاة لأداء فريضة الحج ؟.

الحمد لله
ذكر الله تعالى مصارف الزكاة في قوله : ( إِنَّمَا الصَّدَقَاتُ لِلْفُقَرَاءِ وَالْمَسَاكِينِ وَالْعَامِلِينَ عَلَيْهَا وَالْمُؤَلَّفَةِ قُلُوبُهُمْ وَفِي الرِّقَابِ وَالْغَارِمِينَ وَفِي سَبِيلِ اللَّهِ وَاِبْنِ السَّبِيلِ فَرِيضَةً مِنْ اللَّهِ وَاللَّهُ عَلِيمٌ حَكِيمٌ )
واتفق العلماء على أن قوله تعالى : ( وفي سبيل الله ) المراد به الجهاد في سبيل الله.
ثم اختلفوا هل يشمل مع الجهاد الحج أم لا ؟
فذهب أكثر العلماء إلى أنه خاص بالجهاد ولا يشمل الحج ، وذهب الإمام أحمد إلى أنه يدخل فيه الحج واستدل بما رواه أبو داود (1988) عن أُمِّ مَعْقَلٍ أنها قَالَتْ : يَا رَسُولَ اللَّهِ إِنَّ عَلَيَّ حَجَّةً وَإِنَّ لأَبِي مَعْقَلٍ بَكْرًا ( والبكر هو الفتي من الإبل ) قَالَ أَبُو مَعْقَلٍ صَدَقَتْ جَعَلْتُهُ فِي سَبِيلِ اللَّهِ فَقَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ أَعْطِهَا فَلْتَحُجَّ عَلَيْهِ فَإِنَّهُ فِي سَبِيلِ اللَّهِ . صححه الألباني في صحيح أبي داود .
وثبت عن ابن عمر أنه قال : أَمَا إِنَّ الْحَجَّ مِنْ سَبِيلِ اللَّهِ . قال الحافظ : أَخْرَجَهُ أَبُو عُبَيْد بِإِسْنَادٍ صَحِيحٍ اهـ .

وقال شيخ الإسلام ابن تيمية في "الاختيارات" (105) :
ومن لم يحج حجة الإسلام وهو فقير أعطى ما يحج به اهـ يعني من الزكاة .
وجاء في فتاوى اللجنة الدائمة (10 / 38) :
( يجوز صرف الزكاة في إركاب فقراء المسلمين لحج فريضة الإسلام ، ونفقتهم فيه ، لدخوله في عموم قوله تعالى : ( وَفِي سَبِيلِ اللَّهِ ) من آية مصارف الزكاة اهـ .

Is it permissible to give zakaah to a poor person so that he can perform the obligation of Hajj?.

Praise be to Allaah. Allaah has mentioned the things on which zakaah is to be spent in the verse (interpretation of the meaning):

“As-Sadaqaat (here it means Zakaah) are only for the Fuqaraa’ (poor), and Al-Masaakeen (the poor) and those employed to collect (the funds); and to attract the hearts of those who have been inclined (towards Islam); and to free the captives; and for those in debt; and for Allaah’s Cause (i.e. for Mujaahidoon — those fighting in a holy battle), and for the wayfarer (a traveller who is cut off from everything); a duty imposed by Allaah. And Allaah is All-Knower, All-Wise”

The scholars are agreed that the phrase “for Allaah’s Cause” refers to jihad for the sake of Allaah. But they differed as to whether Hajj is included with jihad or not.
The majority of scholars were of the view that it applies only to jihad and does not include Hajj. Imam Ahmad was of the view that it includes Hajj as well, and he quoted as evidence for that the report narrated by Abu Dawood (1988) from Umm Ma’qal, who said: “O Messenger of Allaah, I need to go for Hajj and Abu Ma’qal has a young camel.” Abu Ma’qal said, “She is telling the truth, and I shall donate it for the sake of Allaah.” The Messenger of Allaah (peace and blessings of Allaah be upon him) said: “Give it to her so that she may go for Hajj on it, for it is for the sake of Allaah.” Classed as saheeh by al-Albaani in Saheeh Abi Dawood.
And it was narrated that Ibn ‘Umar said: “Hajj comes under the heading of for Allaah’s Cause.” Al-Haafiz said: Abu ‘Ubayd narrated it with a saheeh isnaad.

Shaykh al-Islam Ibn Taymiyah said in al-Ikhtiyaaraat, 105:

Whoever has not done the obligatory Hajj and is poor should be given what he needs to do Hajj – i.e. from the zakaah funds.

And it says in Fataawa al-Lajnah al-Daa’imah, 10/38:
It is permissible to give zakaah so that poor Muslims can travel to do the obligatory Hajj, because this comes under the general meaning of the phrase “for Allaah’s Cause” in the verse which speaks of the ways in which zakaah is to be spent.

Allah a précisé les domines d'utilisation de la zakate en ces termes: «Les aumônes ne sont destinées que pour les pauvres, les indigents, ceux qui y travaillent, ceux dont les cœurs sont à gagner (à l'Islam), l'affranchissement des jougs, ceux qui sont lourdement endettés, dans le sentier d'Allah, et pour le voyageur (en détresse). C'est un décret d'Allah! Et Allah est Omniscient et Sage. » (Coran, 9:60)
De l'avis unanime des ulémas, la parole du Très Haut : « dans le chemin d'Allah» signifie l'effort de guerre mené au nom d'Allah.
Mais une divergence de vues apparaît en leur sein sur la question de savoir si le pèlerinage est à inclure dans ce chapitre au même titre que le djihad (guerre religieuse)
La majorité des ulémas soutient que le verset ne vise que le djihad. L'imam Ahmad, au contraire, soutient que le pèlerinage y est inclus. Il se fonde su un hadith rapporté par Abou Dawoud (n°1988) d'après Umm Maaqal qui a dit: «Ô Messager d'Allah, j'ai à effecteur le pèlerinage et Abou Maqaal dispose d'un jeune chameau…» Ce dernier dit: «Elle raison. Je mets le chameau au service d'Allah. Et le Messager d'Allah (bénédiction et salut soient sur lui) de dire: «Donnez le lui pour qu'elle puisse l'utiliser pour son pèlerinage .Car il est devenu une propriété d'Allah.» Déclaré authentique par al-Albani dans Sahihi Abou Dawoud.Voir al-Moughni, 9/328 et al-Madjmou',6/212.
Dans al-ikhiyarat, 105, Cheikh al-islam, Ibn Taymiyya dit: « On doit prélever de la zakate de quoi permettre au pauvre d'effectuer le pèlerinage obligatoire. »
Dans les Fatawa de la Commission Permanente, 10/38, on lit: « Il est permis d'utiliser la zakate pour permettre à des pauvres musulmans d'effectuer le pèlerinage obligatoire, une telle dépense étant imputable à la zakate en vertu de la portée générale de la parole du Très Haut: « et dans le chemin d'Allah.» (Coran, 9:60)
