Extending the time limit for standing in ‘Arafah until dawn on the Day of Sacrifice
Le temps du stationnement à Arafat se prolonge jusqu'à l'aube du jour du Sacrifice
السؤال : أعيش بالسعودية وبإذن الله سأذهب للحج هذا العام ولكن لظروف عملي سأركب الطائرة يوم عرفة الساعة العاشرة صباحا فهل يكون هذا حجاً صحيحاً لو ذهبت يوم عرفة ولم أقم بالمناسك التي قبل يوم عرفة ؟ ولو تأخرت بي الطائرة فوصلت بعد المغرب لجبل عرفة فيكون ضاع علي الحج علمًا بأني أول مرة أحج . ومتى يجب علي أن أكون على عرفة حتى يصبح حجي صحيحاً ؟

الجواب : الحمد لله
لا حرج عليك في الإحرام بالحج في اليوم التاسع من ذي الحجة ، والذهاب إلى عرفة مباشرة ، ويصح حجك إن دخلتها فيما بين الظهر إلى فجر اليوم العاشر ، فكل ذلك وقت للوقوف ؛ لما روى الترمذي (891) والنسائي (3039) وأبو داود (1950) وابن ماجه (3016) عَنْ عُرْوَةَ بْنِ مُضَرِّسِ الطَّائِيِّ قَالَ : أَتَيْتُ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ بِالْمُزْدَلِفَةِ حِينَ خَرَجَ إِلَى الصَّلَاةِ [أي صلاة الفجر] فَقُلْتُ : يَا رَسُولَ اللَّهِ ، إِنِّي جِئْتُ مِنْ جَبَلَيْ طَيِّئٍ ، أَكْلَلْتُ رَاحِلَتِي ، وَأَتْعَبْتُ نَفْسِي وَاللَّهِ مَا تَرَكْتُ مِنْ حَبْلٍ إِلَّا وَقَفْتُ عَلَيْهِ ، فَهَلْ لِي مِنْ حَجٍّ ؟ فَقَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ : ( مَنْ شَهِدَ صَلَاتَنَا هَذِهِ ، وَوَقَفَ مَعَنَا حَتَّى نَدْفَعَ ، وَقَدْ وَقَفَ بِعَرَفَةَ قَبْلَ ذَلِكَ لَيْلًا أَوْ نَهَارًا فَقَدْ أَتَمَّ حَجَّهُ ، وَقَضَى تَفَثَهُ ). قَالَ الترمذي : هَذَا حَدِيثٌ حَسَنٌ صَحِيحٌ . قَالَ : " قَوْلُهُ تَفَثَهُ : يَعْنِي نُسُكَهُ . قَوْلُهُ : ( مَا تَرَكْتُ مِنْ حَبْلٍ إِلَّا وَقَفْتُ عَلَيْهِ ) إِذَا كَانَ مِنْ رَمْلٍ يُقَالُ لَهُ : حَبْلٌ ، وَإِذَا كَانَ مِنْ حِجَارَةٍ يُقَالُ لَهُ : جَبَلٌ ".
وقد حكى غير واحد من العلماء الاتفاق على أن الوقوف بعرفة يمتد إلى فجر يوم النحر .
قال النووي رحمه الله : " وقت الوقوف بين زوال الشمس يوم عرفة وطلوع الفجر ليلة النحر , وهو مذهب مالك وأبي حنيفة والجمهور . وقال القاضي أبو الطيب والعبدري : هو قول العلماء كافةً إلا أحمد فإنه قال : وقته ما بين طلوع الفجر يوم عرفة , وطلوعه يوم النحر" انتهى من "المجموع" (8/ 141).
وقال ابن قدامة رحمه الله : " ولا نعلم خلافا بين أهل العلم في أن آخر الوقت طلوع فجر يوم النحر . قال جابر : " لا يفوت الحج حتى يطلع الفجر من ليلة جَمْع [أي مزدلفة] " . قال أبو الزبير : فقلت له : أقال رسول الله صلى الله عليه وسلم ذلك ؟ قال : نعم . رواه الأثرم .
وأما أوله فمن طلوع الفجر يوم عرفة , فمن أدرك عرفة في شيء من هذا الوقت وهو عاقل , فقد تم حجه .
وقال مالك , والشافعي : أول وقته زوال الشمس من يوم عرفة ...
وكيفما حصل بعرفة , وهو عاقل , أجزأه , قائما أو جالسا أو راكبا أو نائما . وإن مر بها مجتازا , فلم يعلم أنها عرفة , أجزأه أيضا . وبه قال مالك , والشافعي , وأبو حنيفة " انتهى من "المغني" (3/ 211).

وعلى هذا ؛ فمتى وصل الحاج إلى عرفة قبل طلوع فجر يوم النحر ، فقد أدرك الحج ، فعليه أن يأتي بما بقي عليه من المناسك .

Extending the time limit for standing in ‘Arafah until dawn on the Day of Sacrifice
I live in Saudi and by Allah’s leave I will go for Hajj this year, but because of my work I will get on the plane on the day of ‘Arafah at 10 a.m. Will this be a valid Hajj if I go on the day of ‘Arafah and do not do the rituals before the day of ‘Arafah? If the plane is late and I get to Jabal ‘Arafah after sunset, will I have missed out on Hajj? Please note that this is the first time I am doing Hajj. Where do I have to be in ‘Arafah in order for my Hajj to be valid?.

Praise be to Allaah. There is nothing wrong with you entering ihram for Hajj on the ninth day of Dhu’l-Hijjah and going directly to ‘Arafah. Your Hajj will be valid if you enter it between Zuhr and dawn of the tenth day. All of that is the time for standing in ‘Arafah, because of the report narrated by al-Tirmidhi (891), al-Nasaa’i (3039), Abu Dawood (1950) and Ibn Maajah (3016) from ‘Urwah ibn Mudarris al-Taa’i, who said: I came to the Messenger of Allah (blessings and peace of Allah be upon him) in Muzdalifah when he went out to pray [i.e., Fajr prayer]. I said: O Messenger of Allah, I have come from the two mountains of Tayyiy; I have exhausted my camel [because of the long journey] and I have worn myself out. By Allaah there is no sand hill on which I did not stand. Can I still do Hajj? The Messenger of Allah (blessings and peace of Allah be upon him) said: “Whoever attended this prayer of ours and stood with us until we moved on, and stood in ‘Arafah before that, by night or day, has completed his Hajj and completed his rituals.” Al-Tirmidhi said: This is a hasan saheeh hadeeth.
More than one of the scholars have narrated that there was consensus that the standing in Arafat continues until dawn on the Day of Sacrifice. Al-Nawawi (may Allah have mercy on him) said: The time for standing (in ‘Arafah) is between the time when the sun passes its zenith on the day of ‘Arafah and the break of dawn on the Day of Sacrifice. This is the view of Maalik, Abu Haneefah and the majority of scholars. Al-Qaadi Abu’l-Tayyib and al-‘Abdari said: This is the view of all the scholars except Ahmad who said: Its time is between dawn on the day of ‘Arafah and dawn on the Day of Sacrifice. End quote from al-Majmoo‘, 8/141
Ibn Qudaamah (may Allah have mercy on him) said: We do not know of any difference of opinion among the scholars with regard to the end of the standing being dawn on the Day of Sacrifice. Jaabir said: Hajj is not missed until dawn breaks on the day of Muzdalifah. Abu’l-Zubayr said: I said to him: did the Messenger of Allah (blessings and peace of Allah be upon him) say that? He said: Yes. It was narrated by al-Athram. With regard to its beginning, it starts at dawn on the day of ‘Arafah. So whoever reaches ‘Arafah at any point during this time, and is of sound mind, his Hajj is complete.
Maalik and al-Shaafa‘i said: The beginning of his time is when the sun passes its zenith on the day of ‘Arafah…
However the individual reaches Arafat, if he is of sound mind, that is acceptable, whether he is standing, sitting, riding or sleeping. Even if he passes by it without realizing that it is Arafat, that is also acceptable. This is the view of Maalik, al-Shaafa‘i and Abu Haneefah. End quote from al-Mughni, 3/211

Based on that, whenever the pilgrim reaches Arafat before dawn on the Day of Sacrifice, he has done Hajj and he has to perform the rest of the rituals.

Le temps du stationnement à Arafat se prolonge jusqu'à l'aube du jour du Sacrifice

Je vis en Arabie saoudite. Cette année, je vais avec la permission d'Allah faire le pèlerinage. Mes conditions de travail font que je dois prendre l'avion le jour du stationnement à Arafat à 10 heures. Mon pèlerinage serait il correct si je me rendais à Arafat sans passer par l'étape antérieure? Si mon vol accusait un retard et que je n'arrive sur place qu'après la prière du coucher du soleil, raterais-je un pèlerinage que j'effectuerais pour la première fois? A quelle heure faut il se retrouver à Arafat pour valider son pèlerinage?

Louanges à Allah
Il n' y a aucun inconvénient pour vous de commencer votre pèlerinage au 9e jour du 12e lunaire et de vous rendre directement à Arafat. Votre pèlerinage serait valide , si vous arriviez sur place entre le début de l'après midi du 9e jour et l'aube du 10e jour. Ce laps de temps constitue le temps de stationnement. Ceci s'atteste dans ce hadith rapporté par at.-Tirmidhi (891) et par an-Nassai (3039) et par Ibn Madja (3016) d'après Ourwa ibn Moudharris at.-Taai qui a dit: «j'ai rejoint le Messager d'Allah (Bénédiction et salut soient sur lui) à Mouzdalifah au moment où il venait d'accomplir la prière de l'aube. Je lui ai dit: messager d'Allah! Je viens des monts Taai; j'ai exténué ma monture et me suis fatigué. Au nom d'Allah! Je me suis arrêté à toutes les dunes (ou montages de la localité). Mon pèlerinage est il valide? Le Messager d'Allah (Bénédiction et salut soient sur lui) lui dit: «quiconque assiste à notre prière que voilà et attend avec nous notre départ, après s'être auparavant stationné à Arafat un moment du jour ou de la nuit, aura bien accompli son pèlerinage et achevé ses rites.» At.-Tirmidhi dit que le hadith est bon et authentique.
Le terme nafath signifie rites et l'expression : je n'ai laissé une dune ou montage sans m'y arrêter. On dit habl pour parler d'une dune ou djabal pour désigner une montage.
Plus d'un ulémas a raconté l'existence d'un consensus autour de l'idée selon laquelle le temps du stationnement à Arafat s'étend à l'aube du jour du Sacrifice.
An-Nawawi (Puisse Allah lui accorder Sa miséricorde) dit: «le temps du stationnement s'étend du début de l'après midi de la journée d'Arafat jusqu'au début de l'aube du jour du sacrifice. C'est la doctrine de Malik, d'Abou Hanifah et de la majorité. Al-Quadi Abou Tayyib et al-Abdari disent que c'est l'avis de tous les ulémas à l'exception d'Ahmad. En effet, ce dernier dit que ce temps s'étend de l'aube de la journée d'Arafat à l'aube du jour du sacrifice.» Extrait d'al Madjmou',8/141.
Ibn Qudamah (Puisse Allah lui accorder Sa miséricorde) dit: «nous ne sachions pas qu'il existe au sein des ulémas une divergence sur la question que le temps du stationnement à Arafat expire à l'aube du jour du Sacrifice. Djabir dit: on ne rate pas le pèlerinage avant le début de l'aube de la nuit de Djam' (Mouzdalifah). Abou Zoubar dit: je lui ai dit: est-ce le Messager d'Allah (Bénédiction et salut soient sur lui) qui l'a dit? Il dit : oui.» (rapporté par al-Athram. Quant au début du temps de stationnement, c'est l'aube de la journée d'Arafat. Quiconque se retrouve à Arafat pendant ce temps alors qu'il jouit de ses facultés mentales, aura accompli son pèlerinage. Malik et Chafii disent que le temps du stationnement commence au début de l'après midi de la journée d'Arafat. Il suffit se retrouve à Arafat peu importe comment ,pourvu de jouir de ses facultés mentales; que l'on soit assis, debout, monté à bord d'un véhicule ou endormi. Même si on traversait l'espace sans savoir qu'on est à Arafat, cela suffirait encore. C'est l'avis de Malik, de Chafii et d'Abou Hanifah. » Extrait d'al-Moughni, 3/211.

Cela étant, si le pèlerin arrive à Arafat avant l'aube du jour du sacrifice, il aura rattrapé le pèlerinage et devra faire le reste des rites. Nous demandons à Allah d'agréer votre ouvre.
