هل يصوم مع بلده أو مع أي بلد رأى الهلال؟

Should he fast with his own country or with any country that sights the new moon?

Doit il entrer en jeûne avec ses compatriotes ou avec les habitants de tout autre pays où le croissant est aperçu?


ماذا أفعل لو رؤي الهلال في بعض الدول الإسلامية ، ولكن الدولة التي أعمل بها أتمت شهر شعبان ورمضان ثلاثين يوماً ؟ وما السبب في اختلاف الناس في رمضان ؟
الحمد لله
"عليك أن تبقى مع أهل بلدك ، فإن صاموا فصم معهم ، وإن أفطروا فأفطر معهم ؛ لقول النبي صلى الله عليه وسلم "الصوم يوم تصومون ، والإفطار يوم تفطرون ، والأضحى يوم تضحون" ، ولأن الخلاف شر ، فالواجب عليك أن تكون مع أهل بلدك ، فإذا أفطر المسلمون في بلدك فأفطر معهم ، وإذا صاموا فصم معهم .
أما السبب في الاختلاف فهو أن البعض يرى الهلال ، والبعض لا يرى الهلال ، ثم الذين يرون الهلال قد يثق بهم الآخرون ويطمئنون إليهم ويعملون برؤيتهم ، وقد لا يثقون بهم ولا يعملون برؤيتهم ، فلهذا وقع الخلاف ، وقد تراه دولة وتحكم به وتصوم لذلك أو تفطر ، والدولة الأخرى لا تقتنع بهذه الرؤية ولا تثق بالدولة ؛ لأسباب كثيرة ، سياسية وغيرها .
فالواجب على المسلمين أن يصوموا جميعًا إذا رأوا الهلال ، ويفطروا برؤيته ، لعموم قوله عليه الصلاة والسلام "إذا رأيتم الهلال فصوموا ، وإذا رأيتم الهلال فأفطروا ، فإن غم عليكم فأكملوا العدة ثلاثين" ، فإذا اطمأن الجميع إلى صحة الرؤية وأنها حقيقية ثابتة فالواجب الصوم بها والإفطار بها ، لكن إذا اختلف الناس في الواقع ولم يثق بعضهم ببعض ، فإن عليك أن تصوم مع المسلمين في بلدك ، وعليك أن تفطر معهم ، عملاً بقوله صلى الله عليه وسلم "الصوم يوم تصومون ، والفطر يوم تفطرون ، والأضحى يوم تضحون" . وثبت عن ابن عباس رضي الله عنهما أن كريباً لما أخبره أن أهل الشام قد صاموا يوم الجمعة قال ابن عباس : نحن رأيناه يوم السبت ، فلا نزال نصوم حتى نرى الهلال ، أو نكمل ثلاثين ، ولم يعمل برؤية أهل الشام لبعد الشام عن المدينة ، واختلاف المطالع بينهما ، ورأى رضي الله عنهما أن هذا محل اجتهاد ، فلك أسوة بابن عباس ومن قال بقوله من العلماء في الصوم مع أهل بلدك والفطر معهم ، والله ولي التوفيق" انتهى .

Should he fast with his own country or with any country that sights the new moon?
What should I do if the moon is sighted in some Muslim countries but the country where I am working completes the month of Sha’baan and Ramadaan as thirty days? What is the cause of the people’s differences in Ramadaan?.
Praise be to Allaah.
You have to stay with the people of your country. When they fast, then fast with them, and when they break the fast then break the fast with them, because the Prophet (peace and blessings of Allaah be upon him) said: “The fast is the day when you fast, and the breaking of the fast (al-iftaar) is the day when you break the fast, and the sacrifice (al-adha) is the day when you offer the sacrifice.” And because dissent is evil. So you have to be with the people of your country. So when the Muslims in your country break the fast, then break the fast with them, and when they fast then fast with them.
As for the cause of differences, the reason is that some people see the new moon and some do not see it, then those who have seen the new moon may be trusted by others who follow their sighting, or they may not be trusted, and hence differences arise. One country may sight it and rule accordingly, and fast and break the fast on that basis, whereas another country may not be convinced of this sighting and may not trust the other country, for many reasons, political and otherwise.
What the Muslims must do is fast all together when they see the new moon, and break the fast when they see it, because of the general meaning of the words of the Prophet (peace and blessings of Allaah be upon him): “When you see the new moon then fast, and when you see the new moon then break the fast, and if it is too cloudy then complete the number of days as thirty.” If they are all certain of the validity of the moon sighting, and that it is real and proven, then they must fast and break the fast accordingly, but if the people differ and do not trust one another, then you have to fast with the Muslims in your country, and break the fast with them, in accordance with the words of the Prophet (peace and blessings of Allaah be upon him): “The fast is the day when you fast, and the breaking of the fast (al-iftaar) is the day when you break the fast, and the sacrifice (al-adha) is the day when you offer the sacrifice.”
It was proven from Ibn ‘Abbaas (may Allaah be pleased with him) that when Kurayb told him that the people of Syria had started fasting on a Friday, Ibn ‘Abbaas said: We saw it on Saturday, and we will carry on fasting until we see the new moon or we complete thirty days. He did not follow the sighting of the people of Syria because Syria is far away from Madeenah and there may be a difference in moonsighting between the two. He (may Allaah be pleased with him) thought that this was a matter that was subject to ijtihaad. You have a good example to follow in Ibn ‘Abbaas and the scholars who followed him and said that you should fast with the people of your country and break the fast with them. And Allaah is the Source of strength. End quote.

Que devrais-je faire si le croissant lunaire est aperçu dans certains pays musulmans alors le pays où je travaille a porté Cha'bane et Ramadan à 30 jours? Quelle est la cause des divergences à propos du Ramadan?


Louanges à Allah
«Restez avec vos compatriotes; s'ils jeûnent, suivez les. S'ils y mettent fin, faites-en de même, en vertu de la parole du Prophète (Bénédiction et salut soient sur lui): « Le jeûne commence le jour où vous décidez de vous y mettre et prend fin quand vous le terminez. La fête du sacrifice se passe le jour que vous désignez à cet effet.» La divergence étant un mal, vous avez le devoir de vous conformer à la pratique en vigueur dans votre pays. Quand les musulmans de votre pays jeûnent , suivez les. Quand ils mettent fin à leur jeûne , associez vous à eux.
S'agissant des divergences, elles sont dues au fait que certains peuvent apercevoir le croissant lunaire tandis que d'autres ne l'ont pas aperçu. Ces derniers peuvent faire confiance aux premiers et se décident sur la base de leur vision ou ne pas leur faire confiance . Un Etat peut déclarer que le croissant a été aperçu et décide sur cette base de commencer le jeûne tandis qu'un autre pays n'est pas convaincu de cette vision et ne fait pas confiance à l'autre Etat pour de nombreuses raisons politiques et autres.
Les Musulmans devraient jeûner ensemble après avoir aperçu le croissant lunaire et mettre fin à leur jeûne ensemble après l'avoir aperçu, en vertu de la portée générale de la parole du Prophète (Bénédiction et saut soient sur lui): "Quand vous aurez aperçu le croissant lunaire, commencez le jeûne et quand vous l'aurez aperçu encore ( à la fin du mois) mettez fin à votre jeûne. S'il y a des nuages, portez le nombre des jours du mois à 30.» Si tout le monde est assuré que le croissant est certainement bien aperçu, on doit commencer le jeûne ou y mettre fin. S'il y a divergence de vues au sein des gens et que personne ne fait confiance à personne, suivez ce que décident vos compatriotes au début comme à la fin du jeûne, en application de la parole du Prophète (Bénédiction et salut soient sur lui) : « Le jeûne commence le jour où vous décidez de vous y mettre et prend fin que vous e terminez. La fête du sacrifice se passe le jour que vous désignez à cet effet.»
Il a été rapporté de façon sûre d'après Ibn Abbas (P.A.a) que quand Kourayb l'informa que les Syriens avaient débuté le jeûne le vendredi, il dit : «Nous, nous l'avons aperçu le samedi et nous poursuivrons notre jeûne jusqu'à ce que nous le voyions ou comptions 30 jours de jeûne.» Il ne tient pas compte de la vison des Syriens en raison de la distance entre Médine et la Syrie et de la différence des positons de la lune par rapport aux deux localités. Ibn Abbas pensa que la question pouvait faire l'objet d'un effort d'interprétation personnel. Vous pouvez suivre l'exemple d'Ibn Abbas et ceux parmi les ulémas qui ont adopté son opinion et jeûner avec vos compatriotes et mette fin au jeûne avec eux. Allah st le garant de l'assistance.»
