Does touching the penis invalidate wudoo’
Le fait de toucher son organe génital entraine-t-il la rupture des ablutions ?



أعلم أن الغسل من الجنابة يجزئ عن الوضوء سواء توضأ الجنب قبل الغسل أم لم يتوضأ ولكن ماذا عن مس الذكر والإليتين أثناء الغسل ؟ فهل هذا يوجب الوضوء بعد انتهاء الغسل ؟
الحمد لله
إذا اغتسل الجنب ومس ذكره أثناء الاغتسال ، هل يجب عليه الوضوء أم لا ؟
ينبني هذا على اختلاف العلماء في نقض الوضوء بمس الذكر ، فمن رأى أنه ناقض أوجب عليه الوضوء ، ومن رأى أنه غير ناقض فلا يوجب عليه الوضوء .
قال في "الشرح الممتع" : " واختلف العلماء رحمهم الله في مس الذكر والقبل هل ينقض الوضوء أم لا ؟ على أقوال :
القول الأول : وهو المذهب ( أي : مذهب الإمام أحمد) أنه ينقض الوضوء ، واستدلوا بما يلي :
1- حديث بسرة بنت صفوان أن النبي صلى الله عليه وسلم قال : (من مس ذكره فليتوضأ) .

2-حديث أبي هريرة رضي الله عنه : (إذا أفضى أحدكم بيده إلى ذكره ؛ ليس دونها ستر فقد وجب عليه الوضوء) ، وفي رواية : (إلى فرجه) .
3-أن الإنسان قد يحصل منه تحرك شهوة عند مس الذكر ، أو القبل فيخرج منه شيء وهو لا يشعر ، فما كان مظنة الحدث علق الحكم به كالنوم .
القول الثاني : أن مس الذكر لا ينقض الوضوء ، واستدلوا بما يلي :
1 حديث طلق بن علي أنه سأل النبي صلى الله عليه وسلم عن الرجل يمس ذكره في الصلاة : أعليه وضوء ؟ فقال النبي صلى الله عليه وسلم : (لا ، إنما هو بضعة منك) .
2 أن الأصل بقاء الطهارة ، وعدم النقض ، فلا نخرج عن هذا الأصل إلا بدليل متيقن . وحديث بسرة وأبي هريرة ضعيفان ، وإذا كان فيه احتمال ؛ فالأصل بقاء الوضوء . قال صلى الله عليه وسلم : (لا ينصرف حتى يسمع صوتا ، أو يجد ريحا) فإذا كان هذا في السبب الموجب حسا ، فكذلك السبب الموجب شرعا ، فلا يمكن أن نلتفت إليه حتى يكون معلوما بيقين .
القول الثالث : أنه إن مسه بشهوة انتقض الوضوء وإلا فلا ، وبهذا يحصل الجمع بين حديث بسرة ، وحديث طلق بن علي ، وإذا أمكن الجمع وجب المصير إليه قبل الترجيح والنسخ ؛ لأن الجمع فيه إعمال الدليلين ، وترجيح أحدهما إلغاء للآخر .
ويؤيد ذلك قوله صلى الله عليه وسلم : (إنما هو بضعة منك) لأنك إذا مسست ذكرك بدون تحرك شهوة صار كأنما تمس سائر أعضائك ، وحينئذ لا ينتقض الوضوء ، وإذا مسسته لشهوة فإنه ينتقض ؛ لأن العلة موجودة ، وهي احتمال خروج شيء ناقض من غير شعور منك ، فإذا مسه لشهوة وجب الوضوء ، ولغير شهوة لا يجب الوضوء ؛ ولأن مسه على هذا الوجه يخالف مس بقية الأعضاء .
وجمع بعض العلماء بينها بأن الأمر بالوضوء في حديث بسرة للاستحباب ، والنفي في حديث طلق لنفي الوجوب ؛ بدليل أنه سأل عن الوجوب فقال : (أعليه) وكلمة : (على) ظاهرة في الوجوب .
القول الرابع : وهو اختيار شيخ الإسلام أن الوضوء من مس الذكر مستحب مطلقا ، ولو بشهوة .
وإذا قلنا : إنه مستحب ، فمعناه أنه مشروع وفيه أجر ، واحتياط ، وأما دعوى أن حديث طلق بن علي منسوخ ، لأنه قدم على النبي صلى الله عليه وسلم وهو يبني مسجده أول الهجرة ، ولم يعد إليه بعد . فهذا غير صحيح لما يلي :
1- أنه لا يصار إلى النسخ إلا إذا تعذر الجمع ، والجمع هنا ممكن .
2 - أن في حديث طلق علة لا يمكن أن تزول ، وإذا ربط الحكم بعلة لا يمكن أن تزول فإن الحكم لا يمكن أن يزول ؛ لأن الحكم يدور مع علته ، والعلة هي قوله : (إنما هو بضعة منك) ولا يمكن في يوم من الأيام أن يكون ذكر الإنسان ليس بضعة منه ، فلا يمكن النسخ .
3 - أن أهل العلم قالوا : إن التاريخ لا يعلم بتقدم إسلام الراوي ، أو تقدم أخذه ؛ لجواز أن يكون الراوي حدث به عن غيره .
بمعنى : أنه إذا روى صحابيان حديثين ظاهرهما التعارض ، وكان أحدهما متأخرا عن الآخر في الإسلام ، فلا نقول : إن الذي تأخر إسلامه حديثه يكون ناسخا لمن تقدم إسلامه ، لجواز أن يكون رواه عن غيره من الصحابة ، أو أن النبي صلى الله عليه وسلم حدث به بعد ذلك .
والخلاصة : أن الإنسان إذا مس ذكره استحب له الوضوء مطلقا ، سواء بشهوة أم بغير شهوة ، وإذا مسه لشهوة فالقول بالوجوب قوي جدا ، لكني لا أجزم به ، والاحتياط أن يتوضأ" انتهى .
ثم جزم الشيخ رحمه الله في شرح "بلوغ المرام" (1/259) أن مس الذكر بشهوة ناقض للوضوء ، ومسه بدون شهوة غير ناقض .
وعلى هذا القول ؛ فمن مس ذكره بشهوة أثناء الاغتسال من الجنابة وجب عليه الوضوء بعد انتهاء الغسل ، وإذا كان مسه بلا شهوة فلا يلزمه الوضوء .
ثانيًا :
مس الأليتين لا ينقض الوضوء ، والخلاف إنما هو في مس حلقة الدبر ، لأنه قد ورد حديث بسرة بنت صفوان بلفظ : (من مس فرجه فليتوضأ) رواه النسائي (444) وابن ماجه (481) وصححه الألباني في صحيح النسائي .
فالخلاف في مس حلقة الدبر كالخلاف في مس الذكر .
وأما ما جاور ذلك فمسه لا ينقض الوضوء ، كمس الخصيتين والصفحتين .
قال الإمام الشافعي رحمه الله في "الأم" (1/34) : " فإن مس أنثييه أو أليتيه أو ركبتيه ولم يمس ذكره لم يجب عليه الوضوء " انتهى .
وقال النووي رحمه الله في "المجموع" (2/42) : " قال أصحابنا : والمراد بالدبر ملتقى المنفذ , أما ما وراء ذلك من باطن الأليين فلا ينقض بلا خلاف " انتهى .
وقال ابن قدامة رحمه الله : " ولا ينتقض الوضوء بمس ما عدا الفرجين من سائر البدن , كالرُّفغ والأنثيين والإبط , في قول عامة أهل العلم ; لأنه لا نص في هذا ولا هو في معنى المنصوص عليه فلا يثبت الحكم فيه " انتهى باختصار من "المغني" (1/119) . والرُّفْغ : ما حول الفرج ، أو أصول الفخذين من باطن . "مختار الصحاح".

Does touching the penis invalidate wudoo’

I know that ghusl suffices for wudoo’, whether or not the person who is junub does wudoo’ before doing ghusl. But what about touching the penis and buttocks whilst doing ghusl? Does this require wudoo’ after finishing ghusl?

Praise be to Allah If the person who is junub
does ghusl and touches his penis whilst doing ghusl, does that require wudoo’ or not?
That depends on a difference of scholarly opinion as to whether wudoo’ is invalidated by touching the penis. Those who think that it does invalidate wudoo’ say that it is obligatory for him to do wudoo’; those who think that it does not invalidate wudoo’ do not think that it is obligatory for him to do wudoo’.
It says in ash-Sharh al-Mumti‘:
The scholars (may Allah have mercy on them) differed concerning touching the penis or vulva, and whether that invalidates wudoo’ or not. There are several opinions:
The first opinion, which is the view of the madhhab of Imam Ahmad, is that it does invalidate wudoo’. They quoted the following as evidence:
1. The hadeeth of Basrah bint Safwaan, according to which the Prophet (blessings and peace of Allah be upon him) said: “Whoever touches his penis, let him do wudoo’.”
2. The hadeeth of Abu Hurayrah (may Allah be pleased with him): “If one of you puts his hand on his penis with no barrier in between, then he must do wudoo’.” Another report mentions “the private part”.
3. A person may feel aroused when touching the penis or vulva, and something may come out without him realizing; in cases where it is thought likely that wudoo’ may be rendered invalid, the ruling is connected to that (i.e., he must do wudoo’), as in the case of sleep.
The second opinion is that touching the penis does not invalidate wudoo’. They quoted the following as evidence:
1. The hadeeth of Talq ibn ‘Ali, according to which he asked the Prophet (blessings and peace of Allah be upon him) about a man touching his penis whilst praying: does he have to do wudoo’? The Prophet (blessings and peace of Allah be upon him) said: “No; it is just a part of you.”
2. The basic principle is that purity remains in effect and is not rendered invalid, and we do not move from this basic principle unless there is certain evidence to the contrary. The hadeeths of Basrah and Abu Hurayrah [quoted above] are both da‘eef (weak). Even if there was a possibility of them being sound, the basic principle is still that purity remains valid. The Prophet (blessings and peace of Allah be upon him) said: “He (one who thinks that he may have passed wind) should not exit the prayer unless he hears a sound or notices a smell.” If this applies to a tangible reason, it also applies to a textual reason; we cannot pay any attention to it unless it is known for certain.
The third opinion is that if he touches it with desire, that invalidates his wudoo’, otherwise it does not. In this way it is possible to reconcile between the hadeeth of Basrah and the hadeeth of Talq ibn ‘Ali, and if it is possible to reconcile between two text, then we must follow that before looking to see which text is stronger and which may abrogate the other, because reconciling between texts means acting upon texts, whereas looking to see which is stronger means rejecting the other.
This is supported by the words of the Prophet (blessings and peace of Allah be upon him): “it is just a part of you.” That is because if you touch your penis without it provoking desire, it is like touching any other parts of your body; in that case it does not invalidate wudoo’. But if you do touch it with desire then it does invalidate wudoo’, because the reason for the ruling is applicable in this case, which is the possibility of something being emitted that invalidates wudoo’ without you realising it. So if a person touches it with desire, it becomes necessary to do wudoo’, but if that is without desire, then no wudoo’ is required; that is because touching it in this way (with desire) is unlike touching any other part of the body.
Some of the scholars reconcile between the two by noting that the instruction to do wudoo’ in the hadeeth of Basrah is in the sense of it being mustahabb, and the instruction not to do it in the hadeeth of Talq is in the sense of it not being obligatory, based on the fact that he asked whether it was required, and he said “does he have to…?”, and the apparent meaning of the phrase translated here as “does he have to…” indicates that it is obligatory.
The fourth opinion, which was favoured by Shaykh al-Islam Ibn Taymiyah, is that doing wudoo’ after touching the penis is mustahabb (and not obligatory) in all cases, even in the case of desire.
If we say that it is mustahabb, what that means is that it is prescribed and there is reward for doing it, and it is better to do it, so as to be on the safe side. As for the claim that the hadeeth of Talq ibn ‘Ali is abrogated, because he came to the Prophet (blessings and peace of Allah be upon him) when he was building his mosque at the beginning of the Hijrah, and he did not come back to him after that, this is not correct, for the following reasons:
1. We do not move on to abrogation unless it is not possible to reconcile between reports, but reconciling between them is possible in this case.
2. In the hadeeth of Talq there is a reason that cannot cease to be applicable, and if the ruling is connected to the reason that cannot cease to be applicable, then the ruling cannot cease to be applicable, because the ruling is connected to the reason for it. The reason in this case is the words “it is just a part of you.” It is not possible that a man’s penis could ever be said not to be a part of him, so it is not possible for this to be abrogated.
3. The scholars said that the timing of the hadeeth cannot be connected to the time when the narrator became Muslim or from the time he narrated it, because it may be that the narrator of the hadeeth heard it from another Sahaabi.
What is meant is that if two Sahaabis narrate two hadeeths that appear to contradict one another, and one of them came to Islam later than the other, we cannot assume that the hadeeth of the one who came to Islam later abrogates the hadeeth of the one who came to Islam before him, because it is possible that he is narrating from another Sahaabi, or that the Prophet (blessings and peace of Allah be upon him) spoke of it after that.
To sum up: if a person touches his penis, it is mustahabb for him to do wudoo’ in all cases, whether that was with desire or not. If he touched it with desire, then the view that it is obligatory is very strong, but I cannot be definitive about it. However to be on the safe side he should do wudoo’. End quote.
In Sharh Buloogh al-Maraam (1/259), the shaykh (may Allah have mercy on him) stated definitively that touching the penis with desire does invalidate wudoo’, but touching it without desire does not.
According to this opinion, whoever touches his penis with desire whilst doing ghusl for janaabah has to do wudoo’ after he has finished doing ghusl, but if he touched it without desire, he does not have to do wudoo’.
Secondly:
Touching the buttocks does not invalidate wudoo’; the difference of scholarly opinion only has to do with touching the anus, because one version of the hadeeth of Basrah bin Safwaan says: “Whoever touches his private parts, let him do wudoo’.” Narrated by an-Nasaa’i (444) and Ibn Maajah (481); classed as saheeh by al-Albaani in Saheeh an-Nasaa’i.
The difference of opinion on touching the anus is like the difference of opinion on touching the penis.
With regard to the surrounding area, touching it does not invalidate wudoo’, such as touching the testicles or buttocks.
Imam ash-Shaafa‘i (may Allah have mercy on him) said in al-Umm (1/34): If he touches his testicles or buttocks or knees, but he does not touch his penis, then he does not have to do wudoo’. End quote.
An-Nawawi (may Allah have mercy on him) said in al-Majmoo‘ (2/42): Our companions said: What is meant by the backside is the point of exit (the anus); as for anything other than that, between the buttocks, it does not invalidate wudoo’ and there is no difference of scholarly opinion on that point. End quote.
Ibn Qudaamah (may Allah have mercy on him) said: Wudoo’ is not invalidated by touching anything on the entire body other than the private parts, such as the area surrounding the private part or anus, and the testicles, according to the majority of scholars, because there is no text to suggest that and they do not come under the same heading as that which is mentioned in the text, so the ruling cannot apply to them.
End quote from al-Mughni (1/119).

Le fait de toucher son organe génital entraine-t-il la rupture des ablutions ?

Je sais que le bain rituel à prendre à la suite d’une souillure majeure se substitue aux ablutions, que l’intéressé ait fait les ablutions avant le bain ou pas. Mais que dire du fait de toucher le pénis ou les fesses pendant la prise du bain ? Cela nécessite-t-il des ablutions à faire après le bain ?

Louanges à Allah
Si celui qui traine une souillure majeure touche son pénis pendant la prise du bain rituel, doit- il faire des ablutions après ledit bain ?
La réponse dépend du résultat de la divergence des ulémas sur la question de savoir si le fait de toucher le pénis entraîne ou pas la rupture des ablutions. Celui qui pense que cela provoque la rupture des ablutions dit que celles-ci doivent être refaites. Celui qui adopte l’avis contraire, dit que la reprise des ablutions n’est pas nécessaire.
L’auteur d’ach-charh al-momt’i dit : «Une divergence oppose les ulémas (Puisse Allah leur accorder Sa miséricorde) à propos de la question de savoir si le fait de toucher le pénis et le derrière entraîne la rupture des ablutions ou pas ? Il y a des avis sur la question :
Le premier qui est adopté dans la doctrine hanbalite est que cela entraîne la rupture des ablutions. Ses partisans trouvent leur argument dans ces hadiths :
1. Le hadith de Bousratah bint Safwan selon lequel le Prophète (Bénédiction et salut soient sur lui) a dit : « Que celui qui touche son pénis renouvelle ses ablutions.»
2. Le hadith d’Abou Hourayrah (P.A.a) : « Si l’un d’entre vous touche directement son pénis avec sa main, il doit refaire ses ablutions. » Une version dit : « son sexe).
3. On peut éprouver du plaisir en touchent le pénis ou le derrière au point que quelque chose s’écoule à son insu. Or tout ce qui est censé provoquer une souillure entre dans le champ d’application de la disposition (religieuse) comme c’est le cas du sommeil.
Le deuxième avis est que le fait de toucher le pénis n’entraîne pas la rupture des ablutions. Ils tirent leur argument de ce qui suit :
1.Le hadith de Talq ibn Ali selon lequel il interrogea le Prophète (Bénédiction et salut soient sur lui) à propos du cas de quelqu’un qui touche son pénis pendant la prière pour savoir s’il doit reprendre ses ablutions ou pas ? –Le prophète (Bénédiction et salut soient sur lui) lui dit : « Non, ce n’est qu’un de tes organes. »
2. En principe on doit se considérer rituellement propre et donc juger ses ablutions non rompues. Ce principe doit être appliqué jusqu’à la preuve du contraire. Les hadiths de Bousrah et d’Abou Hourayrah sont faibles. A supposer qu’ils soient probablement vrai, le principe veut qu’on maintienne les ablutions. Le Prophète (Bénédiction et salut soient sur lui) a dit : « Qu’il (le fidèle venu prier) ne s’en aille (de la mosquée) à moins d’entendre le son (du pet) ou de sentir une odeur. Si tel est le cas d’une cause ayant un effet matériel, il doit en être de même pour la cause ayant un effet religieux. On ne doit en tenir compte dès qu’on en a une connaissance sûre.
Le troisième avis est que si on éprouve du plaisir en touchant son pénis, ses ablutions sont rompues. Autrement, non. Ceci permet de concilier les hadiths de Nousratah et de Talq ibn Ali. Chaque fois qu’il est possible de concilier des hadiths, il faut y recourir, au lieu de préférer l’un à l’autre ou de juger l’un abrogé car la conciliation permet d’appliquer les deux textes alors que la préférence de l’un revient à annuler l’autre.
Cette solution est corroborée par les propos du Prophète (Bénédiction et salut soient sur lui) : « Ce n’est qu’un de tes organes. » En effet, toucher son pénis sans sensation de plaisir est comme toucher l’un quelque de ses autres organes. Dès lors, un tel acte n’entraîne pas la rupture des ablutions. Si on éprouve du plaisir en touchant l’organe, cela entraîne la rupture des ablutions, la cause étant là, c’est-à-dire la probabilité de la sortie de quelque chose de nature à provoquer la rupture des ablutions à l’insu de l’intéressé. Si on éprouve du plaisir en le touchant, on doit reprendre les ablutions. Si on n’éprouve aucun plaisir, on ne doit pas reprendre les ablutions. C’est parce que toucher le sexe de cette manière est différent de ce qui se passe quand on touche les autres organes.
Des ulémas ont réconcilié les hadiths contradictoires en disant que l’ordre donné dans le hadith de Bousrata de prendre les ablutions va dans le sens d’une simple recommandation alors que la négation qui s’exprime dans le hadith de Talq porte sur le caractère obligatoire puisqu’on lui a demandé si c’était nécessaire en employant une particule qui traduit clairement une obligation.
Le quatrième avis, choisi par cheikh al-islam, est que le renouvellement des ablutions après avoir touché son pénis est une simple recommandation ; qu’on ait éprouvé une sensation de plaisir ou pas. Dire qu’une chose est recommandée c’est dire qu’elle est instituée et qu’elle génère une récompense et constitue une précaution.
Quant à l’allégation selon laquelle le hadith de Talq ibn Ali fut abrogé puisque l’intéressé était arrivé auprès du Prophète (Bénédiction et salut soient sur lui) alors qu’il construisait sa mosquée peu après son immigration et Ali l’avait quitté et n’était jamais revenu est inexact pour ce qui suit :
1. On ne doit recourir à l’abrogation qu’en cas de l’impossibilité de concilier les textes. Or la conciliation est possible.
2. Le hadith de Talq repose sur une cause inaltérable. Or quand une disposition est fondée sur une justification durable, elle devient elle-même durable car les dispositions sont inséparables de leurs causes. Ici, la cause réside dans les propos : « Ce n’est que l’un de tes organes. » Or, il ne viendra jamais un jour où le pénis d’une personne ne sera plus l’un de ses organes ! Aussi l’abrogation reste impossible.
3. Les ulémas ont dit qu’on ne peut savoir la date exacte d’un hadith en se référant uniquement à l’ancienneté de la conversion de son rapporteur à l’islam ou à l’antériorité de son apprentissage des hadiths car il se peut que le rapporteur ait appris le hadith concerné auprès d’un autre (que le Prophète). Autrement dit, si deux compagnons du Prophète (Bénédiction et salut soient sur lui) ont rapporté de lui deux hadiths contradictoires et que la conversion de l’un est postérieure à la conversion de l’autre, on n’en conclut pas en que le hadith de celui dont la conversion est récente abroge le hadith de l’autre car il peut avoir reçu le hadith d’un des compagnons du Prophète ou que ce dernier le lui ait dit tardivement.
En somme, quand quelqu’un touche son pénis, on lui recommande le renouvellement de ses ablutions ; qu’il ait éprouvé du plaisir ou pas. S’il le fait avec plaisir, l’avis selon lequel il doit reprendre ses ablutions est très solide. Mais je n’en suis pas sûr. C’est toujours une précaution de reprendre les ablutions.» Par la suite, le Cheikh affirme résolument dans charh Boulogh al-Maram (1/259) que le fait de toucher son pénis avec plaisir entraîne la rupture des ablutions. Si l’acte ne s’accompagne pas d’une sensation de plaisir, il n’entraîne pas la rupture des ablutions.
Si on se fonde sur cet avis, celui qui touche son pénis avec plaisir pendant la prise du bain rituel doit reprendre ses ablutions après la fin du bain. S’il le fait sans senti du plaisir, il n’est pas tenu de les reprendre.
Deuxièmement, le fait de toucher ses fesses n’entraine pas la rupture des ablutions. La divergence porte sut le fait de toucher l’anus car le hadith de Bousrata bint Safwan est conçu dans ces termes : « Que fasse des ablutions celui qui souche son sexe. » (Rapporté par an-Nassai (444) et par Ibn Madjah (481) et déclaré authentique par al-Albani dans Sahihi an-Nassai. La divergence portant sur le fait de toucher l’anus est comme celle qui porte sur le fait de toucher le pénis. Quant au fait de toucher les organes voisins, comme les testicules et les cuisses, il n’entraîne pas la rupture des ablutions.
L’imam Chafii (Puisse Allah lui accorder Sa miséricorde) écrit dans al-Oumm (1/34) : « Si on touche ses fesses, ou ses testicules ou ses genoux sans toucher le pénis, on ne doit pas faire des ablutions. »
An-Nawawi (Puisse Allah lui accorder Sa miséricorde) dit dans al-Madjmou’ (2/42) : « Nos condisciples disent que par derrière on entend l’anus. Quant à l’intérieur des fesses, il n’est contesté par personne que le fait de le toucher n’entraîne pas la rupture des ablutions. »
Ibn Qoudamah (Puisse Allah lui accorder Sa miséricorde) dit : « Le fait de toucher une des parties du corps, comme les abords du sexe , les testicules et l’aisselle, n’entraîne pas la rupture des ablutions, exception faite du sexe, selon l’avis de la majorité des ulémas car aucun texte ne le prouve et il n’est pas possible de les assimiler à ce qui est précisé dans les textes. Aussi ne leur applique –t-on pas la disposition (applicable à celui qui touche son sexe). Bref extrait d’al-Moughni (1/119) Le terme roufgh désigne les environs du sexe ou l’intérieur des cuisses. Moukhtar as-Sihah.
