La zakat est prescrite au créancier non au débiteur

سؤال : أخذت من رجل مبلغًا وقدره خمسة آلاف ، ولما أخذتها وقضيت بها حاجتي قال لي : عليك زكاة المال الذي أخذته مني ، فقلت له : إنه لا يجوز أن أزكيها . فقال لي : أعدها إليّ كي أزكيها أنا ، ولكن لم أجدها في ذلك الوقت فاضطررت أن أخرج زكاتها ، فهل في هذه الحالة يلزمني شيء ؟
الجواب :
الحمد لله
" ما فعله هذا الرجل محرم من وجهين :
الوجه الأول : أنه طلب زيادة عن القرض ، والقرض لا يجوز أخذ الزيادة أو المنفعة عليه من المقرض ؛ لأنه عقد إرفاق يقصد به الثواب والأجر ، فلا يجوز للمقرض أن يأخذ من المقترض زيادة على القرض وأن يفرضها عليه فرضاً أو يشترطها عليه اشتراطًا ؛ لأن هذا يكون من الربا ، بل هو من أعظم الربا ، وقد قال صلى الله عليه وسلم : " كل قرض جر نفعًا فهو ربا" . والحديث وإن كان فيه مقال ؛ ولكن إجماع أهل العلم على ذلك ، أن المقرض لا يجوز أن ينتفع من مال المقترض بسبب القرض .
فهذا الذي فعله هذا الرجل يكون ربًا ، وعلى هذا الرجل أن يتوب إلى الله وأن يرد هذه الزيادة التي أخذها منك وفرضها عليك .
الوجه الثاني : أن زكاة المال إنما تجب على المالك ولا تجب على غيره ، فإلزامه إياك بدفع الزكاة لا يبرئ ذمته منها ؛ لأن الزكاة واجبة على صاحب الدين ، ودفعها مطلوب منه " انتهى .

Zakaah is obligatory upon the lender, not on the borrower

I took 5000 from a man, and when I had taken it and spend it on my needs, he said to me: You have to pay zakaah on the money that you took from me. I said to him: It is not permissible for me to pay zakaah on it. He said to me: Give it back so that I can pay zakaah on it myself. But I could not afford to do so at that time, so I had no choice but to pay zakaah on it. Is there anything that I have to do in this situation
?.

Praise be to Allaah. What this man has done is haraam for two reasons:
1.
He has asked for something additional to the loan. It is not permissible to take something additional to a loan or to benefit from the loan, because it is a contract that is based on kindness, seeking thereby reward. So it is not permissible for the lender to take from the borrower something that is additional to the loan, or to impose any obligation on him or to stipulate anything for him, because this is riba, and in fact it is the worst kind of riba. The Prophet (blessings and peace of Allaah be upon him) said: “Every loan that brings a benefit is riba.” Even though there is some debate concerning the soundness of this hadeeth, the scholars are unanimously agreed on this point, that the lender is not permitted to benefit from the wealth of the borrower because of the loan.
So what this man has done is riba, and he has to repent to Allaah and return this additional amount that he took from you and imposed on you.
2.
The zakaah on wealth is only due from the owner, not from anyone else. The fact that he forced you to pay zakaah does not mean that his duty has been discharged, because zakaah is due from the one to whom the debt is owed, and he is required to pay it. End quote.

J'ai emprunté 5000 auprès de quelqu'un. Quand je l'ai reçu et utilisé dans mes besoins, il m'a dit: "Tu dois acquitter la zakat de la somme que tu as reçu de moi." Je lui ai dit: il ne m'est pas permis d'en prélever la zakat? Il dit: "Remets la moi alors pour je la soumette à la zakat." Comme je n'en disposais plus, j'ai du en prélever la zakat plus tard..Que devrais-je faire dans ce cas?

Louanges à Allah
Ce que le créancier a fait comporte deux aspects interdits. Le premier est qu'il a demandé un surplus sur le montant du crédit. Or le crédit ne doit pas profiter au créancier. Car il repose sur un contrat accepté pour recevoir une récompense (divine) . Aussi n'est il pas permis au créancier de percevoir un surplus ni de l'exiger ni d'en faire une condition. En effet, il y a là de l'usure sinon pire. Le Prophète (Bénédiction et salut soient sur lui) a dit : « Est usurier tout crédit qui procure un intérêt.»L'authenticité du hadith est certes discutable, mais son contenu fait l'objet du consensus des ulémas. Aussi, l'acte du créancier relève –t-il de l'usure. Il doit se repentir devant Allah et vous restituer ce qu'il a perçu de vous. Le second est que le prélèvement de la zakat sur un bien incombe exclusivement à son propriétaire. Dès lors , le fait de vous obliger à acquitter la zakat ne l'en dispense pas, la zakat étant prescrite personnellement au créancier.»
Allah le sait mieux.
