Pour qui peut-on faire le Sacrifice ?


الحمد لله
أولاً :
تُجزىء الأضحية الواحدة من الغنم عن الرجل وأهل بيته ومن شاء من المسلمين ؛ لحديث عائشة رضي الله عنها أن النبي صلى الله عليه وسلّم أمر بكبشٍ أقرن يطأ في سواد ، ويبرك في سواد ، وينظر في سواد فأُتي به ليضحي به فقال لها : " يا عائشة هلمي المدية ( أي أعطيني السكين ) ففعلت ثم أخذها وأخذ الكبش فأضجعه ثم ذبحه ( أي أخذ يستعد لذبحه ) ثم قال : بسم الله ، اللهم تقبل من محمد ، وآل محمد ، ومن أمة محمد ثم ضحى به " رواه مسلم
وما بين القوسين تفسير وليس من أصل الحديث .
وعن أبي أيوب الأنصاري رضي الله عنه قال : " كان الرجل في عهد النبي صلى الله عليه وسلّم يضحي بالشاة عنه وعن أهل بيته، فيأكلون ويطعمون ". رواه ابن ماجه والترمذي وصححه. وصححه الألباني في صحيح الترمذي 1216
فإذا ضحى الرجل بالواحدة من الغنم الضأن أو المعز عنه وعن أهل بيته أجزأ عن كل من نواه من أهل بيته من حي وميت ، فإن لم ينو شيئاً يعم أو يخص دخل في أهل بيته كل من يشمله هذا اللفظ عرفًا أو لغة ، وهو في العرف لمن يعولهم من زوجات وأولاد وأقارب ، وفي اللغ ة: لكل قريب له من ذريته وذرية أبيه وذرية جده وذرية جد أبيه .
ويجزىء سبع البعير أو سبع البقر عما تجزئ عنه الواحدة من الغنم ، فلو ضحى الرجل بسبع بعير أو بقرة عنه وعن أهل بيته أجزأه ذلك ؛ لأن النبي صلى الله عليه وسلّم جعل سبع البدنة والبقرة قائمًا مقام الشاة في الهدي فكذلك يكون في الأضحية لعدم الفرق بينها وبين الهدي في هذا .
ثانياً :
لا تجزئ الواحدة من الغنم عن شخصين فأكثر يشتريانها فيضحيان بها ؛ لعدم ورود ذلك في الكتاب والسنة، كما لا يجزئ أن يشترك ثمانية فأكثر في بعير أو بقرة ( لكن يجوز اشتراك سبعة في بعير أو بقرة ) ؛ لأن العبادات توقيفية لا يجوز فيها تعدي المحدود كمية وكيفية ، وهذا في غير الاشتراك في الثواب ، فقد ورد التشريك فيه بدون حصر كما سبق .

Praise be to Allaah. One sheep is sufficient as udhiyah for one man and his family and whoever he wants among the Muslims, because of the hadeeth of ‘Aa’ishah (may Allaah be pleased with her) who said that the Prophet (peace and blessings of Allaah be upon him) ordered that a ram with black legs, black belly and black (circles) round the eyes should be brought to him, so that he could sacrifice it. He said to ‘Aa’ishah: “Give me the knife,” and she did that. He took it, then he took the ram, placed it on the ground and then slaughtered it (i.e., prepared to slaughter it), saying: “In the name of Allaah, O Allaah, accept (this sacrifice) on behalf of Muhammad and the family of Muhammad and the ummah of Muhammad.” Then he sacrificed it.
Narrated by Muslim.
It was narrated that Abu Ayyoob al-Ansaari (may Allaah be pleased with him) said: “At the time of the Prophet (peace and blessings of Allaah be upon him), a man would sacrifice a sheep on behalf of himself and his household, and they would eat some and give some to others.” Narrated by Ibn Maajah and by al-Tirmidhi, who classed it as saheeh. Also classed as saheeh by al-Albaani in Saheeh al-Tirmidhi, 1216.
If a man sacrifices a single sheep or goat on behalf of himself and his family, that will suffice for everyone he intended of his family, whether living or deceased. If he did not intend anything specific then it includes all those who are included in this word (family or household) either customarily or linguistically. Customarily it refers to all those whom he supports of wives, children and relatives; linguistically it includes all those who are related to him of his own children and the descendents of his father, grandfather and great-grandfather.
One-seventh of a camel or cow is equivalent to one sheep; if a man sacrifices one-seventh of a camel or cow on behalf of himself and his family, that is sufficient, because the Prophet (peace and blessings of Allaah be upon him) said that one-seventh of a camel or cow takes the place of a sheep in the case of the hadiy (sacrifice offered during Hajj), so that applies also to the udhiyah because there is no difference between the udhiyah and the hadiy in this regard.
Secondly:
If two or more people buy a sheep and sacrifice it, that is not sufficient, because no such thing has been narrated in the Qur’aan and Sunnah. Similarly if eight or more people share one camel or one cow, that is not sufficient (but it is permissible for seven people to share a camel or cow), because acts of worship are as prescribed in the Qur’aan and Sunnah and are not subject to personal opinion; it is not permissible to go beyond the set limits with regard to how much is to be done or the way in which it is to be done. This does not have to do with including others in the reward, because it was narrated that there is no limit to the number of people on whose behalf the sacrifice may be offered.

Louanges à Allah
Premièrement, un seul sacrifice suffit pour un homme, sa famille et ceux parmi les musulmans qu’il veut y inclure. Ceci s’atteste dans un hadith d’Aicha (P.A.a) selon lequel le Prophète (Bénédiction et salut soient sur lui) a donné l’ordre d’égorger un bélier ayant des taches noires autour des yeux, des pattes et sur le ventre. Et il dit : « Ô Aicha, apporte un couteau. » Quand je le lui ai remis, il se saisi du bélier, le coucha par terre et l’égorgea en disant : « Au nom d’Allah. Seigneur, agrée-le de la part de Muhammad, sa famille et sa communauté. » Puis il égorgea la bête. » (Rapporté par Mouslim).
D’après Abou Ayyoub al-Ansari « Du temps du Prophète (Bénédiction et salut soient sur lui), on pouvait sacrifier un mouton pour soi-même et pour sa famille. Et l’on en mangeait et en faisaient manger. » (Rapporté par Ibn Madja et par at-Tirmidhi qui l’a jugé authentique à l’instar d’al-Albani dans Sahih at-Tirmidhi 1216.
Il suffit à un homme de sacrifier un mouton ou une chèvre en son nom et au nom des membres de sa famille, vivants et morts. Si le sacrificateur ne formule pas une intention précise dans le sens de la restriction ou de l’élargissement de la portée de son acte, les membres de la famille comprennent tous ceux qu’on y inclut communément et linguistiquement. La coutume inclut dans la famille tous ceux qu’on prend en charge comme les épouses, les enfants et les proches. La langue applique le vocable à tout proche issu de sa descendance, de celle de son père, de celle de son grand-père et de celle du grand père de son père.
Le septième d’un chameau ou d’un bœuf vaut un mouton. Dès lors, si on sacrifie un tel septième pour soi-même et pour sa famille, cela suffit. En effet, le Prophète (Bénédiction et salut soient sur lui) a rendu le septième d’un chameau ou d’un bœuf égal à un mouton dans les offrandes. Ce qui doit être le cas dans les sacrifices parce qu’il n’y a aucune différence entre les deux à cet égard.
Deuxièmement, un seul mouton ne suffit pas à deux personnes qui l’achètent pour en faire leur sacrifice car cela ne s’atteste pas dans le livre et la Sunna. De même, un chameau ou un bœuf ne suffit pas à 8 personnes ou plus, cette possibilité étant exclusivement réservée à 7 personnes et les actes cultuels étant à recevoir tels quels sans aucune modification qualitative ou quantitative. Contrairement au partage de la récompense qui, lui, n’est objet d’aucune limitation, comme on l’a déjà indiqué.
