س:أفطرت في رمضان بسبب الدورة الشهرية ولم أقض ديني بعد هل لي أن أصوم العشر الأوائل من ذي الحجة ..؟
الحمد لله :
هذه المسألة تعرف عند أهل العلم بصيام النافلة قبل قضاء رمضان ، وفيها خلاف بين العلماء ، فمن العلماء من حرم صيام النافلة قبل قضاء الأيام التي على الإنسان ، لأن البدء بالفرض آكد من النفل ، ومن العلماء من أجاز ذلك .

وقد سئل فضيلة الشيخ محمد بن صالح العثيمين رحمه الله تعالى : عما إذا اجتمع قضاء واجب ومستحب ، فهل يجوز للإنسان أن يفعل المستحب ويجعل قضاء الواجب فيما بعد أو يبدأ بالواجب أولاً مثال : يوم عاشوراء وافق قضاء من رمضان ؟

فأجاب " : بالنسبة للصيام الفريضة والنافلة لا شك أنه من المشروع والمعقول أن يبدأ بالفريضة قبل النافلة ، لأن الفريضة دَيْنٌ واجب عليه ، والنافلة تطوع إن تيسرت وإلا فلا حرج ، وعلى هذا فنقول لمن عليه قضاء من رمضان : اقض ما عليك قبل أن تتطوع ، فإن تطوع قبل أن يقضي ما عليه فالصحيح أن صيامه التطوع صحيح مادام في الوقت سعة ، لأن قضاء رمضان يمتد إلى أن يكون بين الرجل وبين رمضان الثاني مقدار ما عليه ، فمادام الأمر موسعا فالنفل جائز ، كصلاة الفريضة مثلا إذا صلى الإنسان تطوعا قبل الفريضة مع سعة الوقت كان جائزا ، فمن صام يوم عرفة ، أو يوم عاشوراء وعليه قضاء من رمضان فصيامه صحيح ، لكن لو نوى أن يصوم هذا اليوم عن قضاء رمضان حصل له الأجران : أجر يوم عرفة ، وأجر يوم عاشوراء مع أجر القضاء ، هذا بالنسبة لصوم التطوع المطلق الذي لا يرتبط برمضان ، أما صيام ستة أيام من شوال فإنها مرتبطة برمضان ولا تكون إلا بعد قضائه ، فلو صامها قبل القضاء لم يحصل على أجرها ، لقول النبي صلى الله عليه وسلم : « من صام رمضان ثم أتبعه بست من شوال فكأنما صام الدهر » ومعلوم أن من عليه قضاء فإنه لا يعد صائمًا رمضان حتى يكمل القضاء ، وهذه مسألة يظن بعض الناس أنه إذا خاف خروج شوال قبل صوم الست فإنه يصومها ولو بقي عليه القضاء ، وهذا غلط فإن هذه الستة لا تصام إلا إذا أكمل الإنسان ما عليه من رمضان " مجموع فتاوى ابن عثيمين (20/438)
وعلى هذا ، فيجوز لك أن تصومي العشر الأوائل من شهر ذي الحجة على أنها نافلة ، والأفضل لك أن تصوميها بنيّة قضاء رمضان ، ويحصل لك الأجران إن شاء الله تعالى .

Can she observe a voluntary fast when she still owes days from Ramadaan?
I did not fast some days in Ramadaan because of my period, and I have not made up the days I owe yet. Can I fast the first ten days of Dhu’l-Hijjah?.
Praise be to Allaah. This issue is known to the scholars as observing naafil fasts before making up missed Ramadaan fasts. There is a difference of scholarly opinion concerning this matter. Some scholars say that it is haraam to observe naafil fasts before making up days that one owes, because it is more important to start with an obligatory action than a naafil one. Some of the scholars say that it is permissible.
Shaykh Muhammad ibn Saalih al-‘Uthaymeen (may Allaah have mercy on him0 was asked about combining making up a missed obligation and doing something that is mustahabb: is it permissible for a person to do the mustahabb action and make up the obligatory action later on, or should he do the obligatory action first, such as fasting the day ‘Ashoora’ which coincides with making up a missed Ramadaan fast?
With regard to obligatory and voluntary fasts, what is prescribed in sharee’ah and what makes sense is to start with the obligatory fasts and then do the naafil ones, because the obligatory fast is a debt which must be paid, whereas the naafil fast is voluntary and is to be done if one can manage it, otherwise there is no sin on one. Based on this, we say to the one who owes a missed Ramadaan fast: make up what you owe before you observe a voluntary fast. If he observes a voluntary fast before making up what he owes then the correct view is that his voluntary fast is valid so long as there is still enough time to make up the missed fasts, because a person may make up missed Ramadaan fasts so long as there is still enough time for him to do so before the next Ramadaan comes. So long as there is still plenty of time, it is permissible for him to observe voluntary fasts. This is similar to the case of obligatory prayers, such as if a person offers a naafil prayer before an obligatory prayer when there is still plenty of time, this is permissible. Whoever fasts on the day of ‘Arafah or ‘Ashoora’, and still owes some days from Ramadaan, his fast is valid. But if he has the intention of fasting this day to make up for a missed Ramadaan fast, he will have two rewards – one for the day of ‘Arafah or ‘Ashoora’ and another for making up the missed fast. This applies to all voluntary fasts that are not connected to Ramadaan. With regard to fasting the six days of Shawwaal, these are connected to Ramadaan and can only be done after making up missed Ramadaan fasts. If a person fasts these days before making up his missed Ramadaan fasts, he will not get the reward for them, because the Prophet (peace and blessings of Allaah be upon him) said: “Whoever fasts Ramadaan then follows it with six days of Shawwaal, it will be as if he fasted for a lifetime.” It is known that the one who still has some days to make up is not regarded as having fasted Ramadaan until he makes up those days. Some people think that if they fear Shawwaal is going to end soon and they fast the six days even though they still owe some days from Ramadaan, that this is acceptable. This is a mistake, because these six days cannot be fasted until a person has made up the days that he owes from Ramadaan.

Based on this, it is permissible for you to fast the first ten days of Dhu’l-Hijjah as a naafil fast, but it is better for you to fast them with the intention of making up what you owe of Ramadaan, and you will have two rewards in sha Allaah.

J’ai raté des jours du Ramadan à cause de mon cycle menstruel et je n’ai pas encore réglé ma dette. Puissè-je jeûner les dix premiers jours de Dhoul-Hidjdjah ?


Louanges à Allah
Cette question est appelée chez les ulémas la pratique du jeûne surérogatoire avant le rattrapage du Ramadan. Elle est l’objet d’une divergence de vues au sein des ulémas. Une partie d’entre eux, interdit tout jeûne surérogatoire à celui qui a des jours du Ramadan à rattraper car la priorité doit être donnée à l’obligatoire sur le surérogatoire. D’autres le permettent.
Son éminence cheikh Muhammad Salih al-Outhaymine (Puisse Allah Très-haut lui accorder Sa miséricorde) a été interrogée à propos de la coïncidence entre le rattrapage d’une obligation et l’accomplissement d’un acte recommandé pour savoir si on peut se livrer à l’acte recommandé ou donner la priorité au rattrapage de l’obligation. C’est le cas quand le jour d’Achoura arrive alors qu’on a un jour du Ramadan à rattraper.
Voici sa réponse : «S’agissant des jeûnes obligatoire et surérogatoire, il n’y a aucun doute que la loi et la raison veulent qu’on commence par l’obligatoire avant de passer au surérogatoire car le premier est une dette à régler alors que la seconde est à faire volontairement quand on peut le faire en l’absence de la gêne. C’est pourquoi nous disons à celui qui a un jeûne du Ramadan à rattraper : « rattrape le jeûne obligatoire avant de passer au jeûne surérogatoire. »Si toutefois, il faisait l’inverse, son jeûne accompli à titre suréroagoire n’en serait pas moins valide s’il lui reste assez de temps pour accomplir le jeûne obligatoire (avant l’arrivée du prochain Ramadan). Car le temps du rattrapage s’étend du Ramadan passé jusqu’à ce que le nombre de jours qui sépare l’intéressé du Ramadan suivant soit égale au nombre de jours qu’il a à rattraper. Dès lors, si le temps qui reste est assez large, l’accomplissement du surérogatoire reste permis. C’est comme le cas de celui qui accomplit des prières surérogatoire dans le temps réservé à la prière obligatoire puisque ce temps est assez large pour le lui permettre.
Celui qui jeûne le jour d’Arafah ou le jour d’Achoura alors qu’il a des jours du Ramadan à rattraper, son jeûne reste valide. Mais s’il nourrissait la double intention de jeûner ces jours à titre surérogatoire mais aussi pour remplacer un jour non jeûné du Ramadan, il obtiendrait deux récompenses ; une pour avoir jeûné le jour d’Arafah ou celui d’Achoura et une autre pour avoir rattrapé le jeûne du Ramadan.
Ceci concerne le jeûne surérogatoire absolu sans lien avec le Ramadan. Quant au jeûne des six jours de Shawwal, il est lié à celui du Ramadan car il ne peut être observé qu’au sortir de ce mois. Si on les jeûnait avant l’arrivée du Ramadan, on n’obtiendrait aucune récompense. En effet, le Prophète (Bénédiction et salut soient sur lui) a dit : «Celui qui observe le jeûne du Ramadan et le fait suivre par le jeûne de six jours de Shawwal est comme celui qui aurait jeuné tout le temps. » Or, il est bien connu que celui qui a du jeûne à rattraper n’a pas jeûné tout le Ramadan. A propos de cette question, certaines personnes pensent qu’en cas de crainte de l’écoulement de Shawwal avant qu’elles n’aient la possibilité de jeûner les six jours, elles doivent s’empresser à les jeûner même si elles avaient des jours du Ramadan à rattraper. C’est une erreur car on ne se livre au jeûne des six jours qu’après avoir complété celui du Ramadan. » Voir Madjmou fatwas d’Ibn Outheymine (20/438).
Cela étant, il vous est permis de jeûner les dix premiers jours du mois de Dhoul Hidjdja à titre surérogatoire. Il est toutefois préférable que vous le fassiez avec l’intention de rattraper le jeûne du Ramadan afin d’en être récompensée doublement, s’il plait à Allah Très-haut. Se référer à la question n° 23429.
