Le statut du jeûne pratiqué pendant les 11e, 12e et 13e jours du 12e mois du calendrier musulman
اعتدت أن أصوم كل خميس وصادف أني صمت يوم الخميس الموافق 12 ذو الحجة وقد سمعت يوم الجمعة انه لا يجوز صيام أيام التشريق والخميس هو ثالث أيام التشريق . فهل علي شيء أني صمته؟؟ وهل فعلا لا يجوز صيام أيام التشريق أو فقط لا نصوم أول أيام العيد ؟؟.


الحمد لله
صيام يومي العيدين محرم ، ويدل لذلك حديث أبي سعيد الخدري رضي الله عنه قال : ( نَهَى النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ عَنْ صَوْمِ يَوْمِ الْفِطْرِ وَالنَّحْرِ) . رواه البخاري (1992) ، ومسلم (827) . وقد أجمع العلماء على أن صومهما محرم .
كما يحرم صيام أيام التشريق وهي الأيام الثلاثة بعد يوم عيد الأضحى ( الحادي عشر ، والثاني عشر ، والثالث عشر ، من شهر ذي الحجة ) لقوله صلى الله عليه وسلم : " أيام التشريق أيام أكل وشرب وذكر لله " رواه مسلم (1141) .
وروى أبو داود (2418) عَنْ أَبِي مُرَّةَ مَوْلَى أُمِّ هَانِئٍ أَنَّهُ دَخَلَ مَعَ عَبْدِ اللَّهِ بْنِ عَمْرٍو عَلَى أَبِيهِ عَمْرِو بْنِ الْعَاصِ فَقَرَّبَ إِلَيْهِمَا طَعَامًا ، فَقَالَ : كُلْ . فَقَالَ : إِنِّي صَائِمٌ . فَقَالَ عَمْرٌو : كُلْ فَهَذِهِ الأَيَّامُ الَّتِي كَانَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ يَأْمُرُنَا بِإِفْطَارِهَا ، وَيَنْهَانَا عَنْ صِيَامِهَا . قَالَ الإمام مَالِكٌ : وَهِيَ أَيَّامُ التَّشْرِيقِ . وصححه الألباني في صحيح أبي داود .
لكن يجوز صوم أيام التشريق للحاج الذي لم يجد الهدي فعن عائشة وابن عمر رضي الله عنهم قالا " لم يرخص في أيام التشريق أن يصمن إلا لمن لم يجد الهدي " رواه البخاري (1998) .
قال الشيخ ابن عثيمين رحمه الله : " يجوز للقارن والمتمتع إذا لم يجدا الهدي أن يصوما هذه الأيام الثلاثة حتى لا يفوت موسم الحج قبل صيامهما . وما سوى ذلك فإنه لا يجوز صومها ، حتى ولو كان على الإنسان صيام شهرين متتابعين فإنه يفطر يوم العيد والأيام الثلاثة التي بعده ثم يواصل صومه " فتاوى رمضان ص 727

Ruling on fasting the days of al-Tashreeq
I have the habit of fasting every Thursday and it so happened that I fasted on Thursday 12th Dhu’l-Hijjah. On the Friday I heard that it is not permissible to fast on the Days of al-Tashreeq and that Thursday was the third of the days of al-Tashreeq. Is there any sin on me if I fasted that day? Is it true that it is not permissible to fast on the days of al-Tashreeq or should we avoid fasting only on the first days of Eid

Praise be to Allaah. Fasting on the two days of Eid is haraam, as indicated by the hadeeth of Abu Sa’eed al-Khudri (may Allaah be pleased with him) who said: The Prophet (peace and blessings of Allaah be upon him) forbade fasting on the day of al-Fitr and al-Nahr.” Narrated by al-Bukhaari, 1992; Muslim, 827. The scholars are unanimously agreed that fasting on these two days is haraam.
It is also haraam to fast on the days of al-Tashreeq which are the three days after Eid al-Adha (the 11th, 12th and 13th of Dhu’l-Hijjah) because the Prophet (peace and blessings of Allaah be upon him) said: “The days of al-Tashreeq are days of eating, drinking and remembering Allaah.” Narrated by Muslim, 1141.
Abu Dawood (2418) narrated from Abu Murrah the freed slave of Umm Haani that he entered with ‘Abd-Allaah ibn ‘Amr upon his father ‘Amr ibn al-‘Aas. He offered them food and said, “Eat.” He said, “I am fasting.” ‘Amr said: “Eat, for these are the days on which the Messenger of Allaah (peace and blessings of Allaah be upon him) would tell us not to fast and forbade us to fast, and these are the days of al-Tashreeq.” Classed as saheeh by al-Albaani in Saheeh Abi Dawood.
But it is permissible to fast on the days of al-Tashreeq for a pilgrim who does not have a hadiy (sacrificial animal). It was narrated that ‘Aa’ishah and Ibn ‘Umar (may Allaah be pleased with them) said: No one was allowed to fast on the days of al-Tashreeq except one who could not find a hadiy. Narrated by al-Bukhaari, 1998.
Shaykh Ibn ‘Uthaymeen said: It is permissible for those who are doing Hajj qiraan or tamattu’, if they cannot find a hadiy, to fast these three days so that the Hajj season will not end before they fast. But apart from that it is not permissible to fast on these days, even if a person is obliged to fast for two consecutive months; he should not fast on the day of Eid and the three days following it, but then he should continue his fast.

Le statut du jeûne pratiqué pendant les 11e, 12e et 13e jours du 12e mois du calendrier musulman


J’ai l’habitude de jeûner le jeudi, et, une fois, ce jour a coïncidé avec le 12 du jour 12e mois lunaire. Or, j’ai entendu le vendredi (suivant) qu’il n’était pas permis de jeûner les jours dits de tashriq (11e, 12, et 13e) donc le jeudi que j’ai jeûné et qui coïncidait avec le 13e jour. Devrais-je accomplir un acte d’expiation pour cela ? Est-il réellement interdit de jeûner tous ces jours-là ou seulement le jour de la fête ?

Louange à Allah
Il est interdit de jeûner les deux jours de fête (fête de la rupture du jeûne et fête du Sacrifice), compte tenu du hadith d’Abou Said al-Khoudri (P.A.a) dans lequel il dit : « le Prophète (bénédiction et salut soient sur lui) a interdit de jeûner le jour de la fête de rupture de jeûne et le jour de la fête du Sacrifice » (rapporté par al-Boukhari, n° 1992 et par Mouslim, n° 827).
Les ulémas sont tous d’avis qu’il est interdit de les jeûner. De même, il est interdit de jeûner les trois jours suivant celui de la fête du Sacrifice, en vertu de cette parole du Prophète (bénédiction et salut soient sur lui) : « les jours de tashriq sont des jours pendant lesquels on doit manger, boire et rappeler Allah » (rapporté par Mouslim, n° 1141).
Abou Dawoud a rapporté (n° 2418) d’après Abi Mourra, l’affranchi d’Um Hani, qu’il s’était rendu en compagnie d’Abd Allah ibn Amr ibn al-As auprès d’Amr Ibn al-As et que ce dernier leur offrit de la nourriture et dit à Abd Allah : « mange ! » - « J’observe le jeûne » - « Mange, car pendant ces jours, le Messager d’Allah (bénédiction et salut soient sur lui) nous donnait l’ordre de cesser de jeûner et nous interdisait le jeûne ». L’imam Malick dit que les jours en question sont dits de ceux tashriq. (hadith déclaré authentique par al-Albani dans Sahihi Abi Dawoud).
Cependant il est permis au pèlerin qui ne possède pas une bête à sacrifier de jeûner les dits jours. En effet, Aïcha et Ibn Omar (P.A.a) disent : « seul le pèlerin qui ne possède pas un sacrifice est autorisé à jeûner ces jours. » (rapporté par al-Boukhari, n° 1998).
Cheikh Ibn Outhaymine (Puisse Allah lui accorder Sa miséricorde) a dit : « Il est permis à celui qui a opté pour le quiran (jonction des deux pèlerinages) mineur et majeur) et celui qui a opté pour le tamatou’ (séparation des deux pèlerinages par une pause marquée par le retour à l’état ordinaire), il est permis à ces deux-là, au cas où ils ne possèdent pas une bête à sacrifier, de jeûner les trois jours sus-indiqués, pour éviter que le temps du pèlerinage ne s’écoule avant qu’ils ne s’acquittent du jeûne. En dehors de ce cas, il n’est pas permis de les jeûner. Même si on avait à jeûner deux mois successifs, on serait tenu de cesser le jeûne pendant les jours de fête et les trois jours susmentionnés, quitte à reprendre le jeûne plus tard. » Voir Fatawa Ramadan, p. 727.
