هل تجوز الأضحية بالحامل من الحيوان ؟

Is it permissible to offer a pregnant animal as an udhiyah?

Est-il permis de faire d'une bête enceinte un sacrifice?

السؤال :
هل يحل أن نضحي بالحبلى من الحيوان ؟ لو أن الأمر جائز ، فماذا ينبغي أن نفعل مع الجنين؟

الجواب :
الحمد لله
أولا :
الأضحية : من شعائر الإسلام المشروعة بكتاب الله تعالى ، وسنة رسوله صلى الله عليه وسلّم ، وإجماع المسلمين ، وقد سبق بيان هذا في الفتوى رقم : (36432) .
وينظر أيضا في بيان شروط الأضحية : الفتوى رقم : (36755) .
ثانيًا :
اختلف العلماء في جواز التضيحة بالحامل من بهيمة الأنعام ؛ فذهب الجمهور إلى جواز التضحية بها ، ولم يذكروا الحمل في عيوب الأضحية التي تمنع من الإجزاء .
وخالف الشافعية ، فذهبوا إلى المنع من التضحية بالحامل .
جاء في الموسوعة الفقهية الكويتية (16 / 281):
"ولم يذكر جمهور الفقهاء الحمل عيبا في الأضحية ، خلافا للشافعية ، حيث صرحوا بعدم إجزائها في الأضحية ؛ لأن الحمل يفسد الجوف ويصير اللحم رديئًا " انتهى.
وفي " حاشية البجيرمي على الخطيب " (4 / 335) وهو من كتب الشافعية:
" والحامل لا تجزئ, وهو المعتمد [ يعني : في المذهب ] ؛ لأن الحمل ينقص لحمها وإنما عدوها كاملة في الزكاة ، لأن القصد فيها النسل دون طيب اللحم" انتهى بتصرف.
والراجح أن الحامل من بهيمة الأنعام تجزئ في الأضحية , إذا لم يكن بها مانع آخر .
قال الشيخ محمد بن إبراهيم رحمه الله :
" يصح التضحية بالشاة الحامل ، كما يصح بالحائل ، إذا كانت سليمة من العيوب المنصوصة في الأضاحي " انتهى من "فتاوى ورسائل الشيخ محمد بن إبراهيم" (6/146) .
ثالثًا :
الجنين إذا خرج حيا فإنه يذكى ويؤكل .
قال ابن قدامة في "المغني" (9/321) : " فَإِنْ خَرَجَ حَيًّا حَيَاةً مُسْتَقِرَّةً , يُمْكِنُ أَنْ يُذَكَّى , فَلَمْ يُذَكِّهِ حَتَّى مَاتَ , فَلَيْسَ بِذَكِيٍّ ، قَالَ أَحْمَدُ : إنْ خَرَجَ حَيًّا , فَلَا بُدَّ مِنْ ذَكَاتِهِ ; لِأَنَّهُ نَفْسٌ أُخْرَى " انتهى .
وإذا خرج ميتا : فجمهور العلماء على أنه يؤكل أيضا ؛ لأنه قد ذكي بذكاة أمه .
روى أبو داود (2828) والترمذي (1476) وصححه, وابن ماجة (3199) وأحمد (10950) عَنْ أَبِي سَعِيدٍ عَنْ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ قَالَ" ذَكَاةُ الْجَنِينِ ذَكَاةُ أُمِّهِ "وصححه الألباني في " صحيح الجامع " (3431) .
وهذا – كما ذكرنا - مذهب جماهير أهل العلم ، خلافا للحنفية .
قال شيخ الإسلام ابن تيمية في مجموع الفتاوى (26 / 307) :
" والأضحية بالحامل جائزة , فإذا خرج ولدها ميتا : فذكاته ذكاة أمه عند الشافعي وأحمد وغيرهما , سواء أشعر أو لم يشعر, وإن خرج حيا ذبح .
ومذهب مالك : إن أشعر حل ، وإلا فلا .
وعند أبي حنيفة لا يحل حتى يذكى بعد خروجه " انتهى.
وقد سبق بيان هذه المسألة بالتفصيل, وسبق الحديث أن بعض أهل العلم كره أكل الجنين من جهة الطب . ينظر الفتوى رقم: (182410) .

Is it permissible to offer a pregnant animal as an udhiyah?
Is it permissible for us to offer a pregnant animal as an udhiyah? If that is permissible, then what should we do with the foetus?
Praise be to Allah.
Firstly:
The udhiyah is one of the rituals of Islam that is prescribed by the Book of Allah, may He be exalted, and the Sunnah of His Messenger (blessings and peace of Allah be upon him), and by the consensus of the Muslims. This has been discussed in fatwa no. 36432.
For information on the conditions of the udhiyah, please see fatwa no. 36755.
Secondly:
The scholars differed as to whether it is permissible to offer a pregnant livestock animal as an udhiyah. The majority are of the view that it is permissible to offer it as an udhiyah, and they did not mention pregnancy among the faults or defects that render an animal unacceptable as an udhiyah.
The Shaafa‘is differed from that, and were of the view that a pregnant animal should not be offered as an udhiyah.
It says in al-Mawsoo‘ah al-Fiqhiyyah al-Kuwaitiyyah (16/281):
The majority of fuqaha’ did not mention pregnancy as a defect with regard to the udhiyah, apart from the Shaafa‘is, who stated clearly that a pregnant animal is not acceptable as an udhiyah, because pregnancy affects the meat. End quote.
It says in Haashiyat al-Bujayrami ‘ala al-Khateeb (4/335), which is a Shaafa‘i book:
The pregnant animal is not acceptable, and this is the view of our madhhab, because pregnancy affects the meat. Rather it is regarded as acceptable in the case of zakaah, because what is sought in that case is the offspring, not the quality of the meat. End quote.
The correct view is that a pregnant livestock animal is acceptable as an udhiyah, if there is no other defect in it. Shaykh Muhammad ibn Ibraaheem (may Allah have mercy on him) said:
It is acceptable to sacrifice a pregnant sheep, if it is free of the defects mentioned in conjunction with sacrificial animals.
End quote from Fataawa wa Rasaa’il ash-Shaykh Muhammad ibn Ibraaheem (6/146)
Thirdly:
If the foetus is extracted alive, then it should be slaughtered in the prescribed manner and may be eaten.
Ibn Qudaamah said in al-Mughni (9/321):
If it is extracted alive and in stable condition, and it could be slaughtered, but it is not slaughtered until it dies, then it is not regarded as having been slaughtered in the prescribed manner. Ahmad said: If it is extracted alive, then it must be slaughtered in the prescribed manner, because it is a separate soul. End quote.
If it is extracted dead, then the majority of scholars are of the view that it may also be eaten, because it is as if it was slaughtered when its mother was slaughtered in the prescribed manner.
Abu Dawood (2828), at-Tirmidhi (1476 – and he classed it as saheeh), Ibn Maajah (3199) and Ahmad (10950) narrated from Abu Sa‘eed that the Prophet (blessings and peace of Allah be upon him) said: “The foetus is slaughtered when its mother is slaughtered (in the prescribed manner).” Classed as saheeh by al-Albaani in Saheeh al-Jaami‘ (3431).
This – as we have mentioned – is the view of the majority of scholars, with the exception of the Hanafis.
Shaykh al-Islam Ibn Taymiyah said in Majmoo‘ al-Fataawa (26/307):
Sacrificing a pregnant animal as an udhiyah is permissible. If the foetus is extracted dead, then its slaughter was the slaughter of its mother, according to ash-Shaafa‘i, Ahmad and others, regardless of whether it had any hair or not. If it was extracted alive, then it should be slaughtered.
The view of Maalik is that is if it had hair, it is permissible, otherwise it is not.
According Abu Haneefah, it is not permissible unless it is slaughtered in the prescribed manner after it is extracted. End quote.
This issue has previously been discussed in detail, and we noted that some of the scholars regarded it preferable not to eat the foetus from a medical point of view. See fatwa no. 182410.

Est-il permis de sacrifier une bête enceinte? A supposer que cela soit permis que faire du fœtus?



Louanges à Allah
Premièrement, le Sacrifice est un rituel islamique institué par le livre d'Allah Très-haut et la Sunna de Son Messager (Bénédiction et salut soient sur lui) et par le consensus des musulmans. Ceci a été expliqué dans la fatwa n°36432. Voir encore à propos de l'explication des conditions du choix de la bête à sacrifier la fatwa n° 36755.
Deuxièmement, une divergence oppose les ulémas à propos de la permission du choix d'une bête enceinte comme sacrifice. La majorité des ulémas l'autorise puisqu'ils ne mentionnent pas la grossesse parmi les défauts qui empêchent une bête de servir de sacrifice. Les chafiites soutiennent l'interdiction de se servir d'une telle bête comme sacrifice.
On lit dans l'encyclopédie koweitienne (16/281) «Les jurisconsultes n'ont pas mentionné la grossesse comme un défaut de l'animal à sacrifier. Au contraire, les chafiites, déclarent sans ambages qu'une bête enceinte ne peut pas servir de sacrifice car la grossesse détériore le ventre et partant la qualité de la viande.»
On lit dans Hachyatoul Bajirmi sur al-Khatib (4/335), un des ouvrages des chafiites:« La bête enceinte ne suffit pas (comme sacrifice) selon l'avis retenu ]dans la doctrine[ car la grossesse déprécie la viande. On n'a compté une telle bête parfaite dans la zakat que parce que parce que là on vise la reproduction non la qualité de la viande.»
L'avis le mieux argumenté est que la bête enceinte peut servir de sacrifice, s'il est exempt de défaut.
Cheikh Muhammad ibn Ibrahim (Puisse Allah lui accorder Sa miséricorde):«On peut sacrifier une brebis enceinte comme on le fait avec celle non enceinte, pourvu qu'elle soit exempte des défauts qui frappent les bêtes pouvant servir de sacrifice.» Extrait des fatwa wa rassail du Cheikh Muhammad ibn Ibrahim (6/146).
Troisièmement, quant une bête met bas un petit vivant, on peut l'égorger et manger. Ibn al-Qoudamah écrit dans al-Moughni (9/321):« Si le petit sort vivant de façon si stable qu'on peut l'égorger et qu'on ne l'égorge jusqu'à ce qu'il meure naturellement, il n'est plus bon. Ahmad dit qu'il faut l'égorger s'il sort vivant car c'est une autre âme.» Si le petit nait mort, la majorité des ulémas soutient qu'on peut pas le manger car égorger sa mère c'est l'égorger.
Abou Dawoud (2828) et at-Tirmidhi (1476), ibn Madjah (3199)et Ahmad (10950) ont rapporté d'après Abou Said que le Prophète (Bénédiction et salut soient sur lui) a dit:« Egorger une bête enceinte c'est égorger son petit.» At-Tirmidhi l'a jugé authentique et al-Alani dans Sahih al-Djaami (3431).
Comme nous l'avons mentionné, ceci correspond à la doctrine de la majorité des ulémas, à l'exception des hanafites.
Cheikh al-islam, Ibn Taymiya écrit dans Madjmou'al-fatwa (26/307):«Il est permis de sacrifier une bête enceinte. Si son petit sort mort , il est jugé égorgé puisque sa mère l'est selon l'avis de Chafii , Ahmad et d'autres; que le petit soit porteur de poils ou pas. Si le petit nait vivant, on l'égorge. Selon Malick, si le petit porte des poils, il est licite de le consommer sinon il ne l'est pas. Pour Abou Hanifa, il n'est licite de le consommer que si on l'égorge après sa naissance.»
Cette question a déjà été exhaustivement expliquée. On a déjà évoqué la réprobation par certains ulémas de la consommation de la viande des fœtus pour une raison de santé. Voir la fatwa 182410.
